Resolution No. 116/NQ-CP dated September 24, 9 on supporting employees and employers affected by the COVID-2021 pandemic

The Government issued a resolution to implement policies to support employees and employers affected by the COVID-19 pandemic from the Unemployment Insurance Fund.

1. Financial support for employees affected by the COVID-19 pandemic from the unemployment insurance fund balance

a) Subjects of application

  • Employees participating in unemployment insurance as of September 30, 9 (excluding employees working at state agencies, political organizations, socio-political organizations, and units) the people 's armed forces and public non - service units are covered by the state budget for recurrent expenditure ) .
  • Employees who have stopped participating in unemployment insurance due to termination of their labor contracts or working contracts between January 01, 01 and September 2020, 30 have a period of unemployment insurance premium payment. are reserved in accordance with the provisions of the law on employment, excluding persons receiving monthly pensions.

b) Support level

The support level is based on the period of unemployment insurance premium payment not yet enjoying unemployment allowance of the employee, specifically as follows:

  • Unemployment insurance payment period under 12 months: support 1.800.000 VND/person.
  • Unemployment insurance payment period from full 12 months to less than 60 months: support 2.100.000 VND/person.
  • Unemployment insurance payment period from full 60 months to less than 84 months: support 2.400.000 VND/person.
  • Unemployment insurance payment period from full 84 months to less than 108 months: support 2.650.000 VND/person.
  • Unemployment insurance payment period from full 108 months to less than 132 months: support 2.900.000 VND/person.
    Unemployment insurance premium payment period from 132 months or more: support 3.300.000 VND/person.

c) Funding source: about 30.000 billion VND from the balance of the Unemployment Insurance Fund until the end of 2020.

d ) The time to implement support for employees is from October 01, 10 and to be completed by December 2021, 31 at the latest.

2. Reducing the contribution to the Unemployment Insurance Fund for employers affected by the COVID-19 pandemic

a) Subjects of application:

Employers specified in Article 43 of the Employment Law (excluding state agencies, political organizations, socio-political organizations, people's armed forces units and public non-business units) recurrent expenditures by the state budget) are participating in unemployment insurance before October 01, 10.

b) Amount of payment reduction:

The employer is entitled to reduce the contribution rate from 1% to 0% of the monthly salary fund of employees who are subject to unemployment insurance.

c) Time to reduce the payment level:

12 months, from October 01, 10 to the end of September 2021, 30.

3. Do and get support

1. For employees participating in unemployment insurance

a) The social insurance agency makes a list of employees participating in unemployment insurance according to Form No. 01 and sends it to the employer. By the end of October 20, 10, the social insurance agency must complete sending the list to all employers and publicize the list of supported employees on the information page. electronic information of the provincial social insurance agency.

b) Within 05 working days after receiving the list sent by the social insurance agency, the employer shall publicize the list of employees eligible for support so that the employees know, compare and supplement information (if any); make and send a list of employees with correct and sufficient information and employees who voluntarily do not receive support according to Form No. 02 to the social insurance agency.

The employer makes a list of information of the employee that needs to be adjusted according to Form No. 03 (if any), and sends it to the social insurance agency, enclosed with a document proving the adjusted information in accordance with the law. , no later than the end of November 10, 11.

c) Within 10 working days from the date of receipt of the correct and complete list of employees and within 20 days from the date of receiving the list of employees with adjusted information provided by the employer; sent to, the social insurance agency pays support to the employee. Encourage payment through employees' bank accounts.

In case of non-payment of support, the social insurance agency shall notify in writing and clearly state the reason.

2. For employees who have stopped participating in unemployment insurance

a) The employee requests the social insurance agency of the province or district where the employee needs to receive support using Form No. 04. The time limit for receiving the request for support is December 20, at the latest. 12.

b) Within 10 working days from the date of receiving the employee's request for support, the social insurance agency shall pay the support payment to the employee, the time for completion is December 31 at the latest. 12. Encourage payment through employees' bank accounts.

In case of non-payment of support, the social insurance agency shall notify in writing and clearly state the reason.
