2. What are the conditions for certification of a science and technology enterprise?
Article 6, Decree 13/2019/ND-CP stipulates: Conditions for granting certificates of science and technology enterprises
1. An enterprise shall be granted a certificate of science and technology enterprise when it meets the following conditions:
a) Being established and operating under the Law on Enterprises;
b) Having the ability to create or apply scientific and technological results which are evaluated, appraised and recognized by a competent authority according to the provisions of Clause 2, Article 7 of this Decree;
c) Having a turnover from the production and trading of products formed from scientific and technological results reaching at least 30% of total revenue.
2. A newly established enterprise under 5 years old satisfying the conditions specified at Points a and b, Clause 1 of this Article shall be certified as a science and technology enterprise.
3. Procedures and dossiers of application for certification of science and technology enterprises
Article 7, Decree 13/2019/ND-CP stipulates: Procedures and dossiers of application for certification of science and technology enterprises
1. Enterprises that satisfy the conditions specified in Article 6 of this Decree shall send 01 application for certification of science and technology enterprises to the competent authority as prescribed in Article 5 of this Decree. Applications can be submitted in person, by post or online.
2. An application for certification of a science and technology enterprise includes:
a) An application for certification of a science and technology enterprise is made according to Form No. 01 in the Appendix to this Decree;
b) A written certification and recognition of scientific and technological results by a competent authority (a copy to be presented with the original for comparison or a certified true copy), in one of the following documents:
- Diploma of protection of intellectual property rights;
- Decision on recognition of new plant varieties, new livestock breeds, new aquatic varieties, new forestry plant varieties and technical advances;
- Certificate of award for the performance of tasks that have won prizes in science and technology, presided over by competent state agencies, coordinated in organizing the awarding or giving consent to the organization. the awarding organization;
- Decision on recognition of results of performance of scientific and technological tasks funded with the state budget or Certificate of registration of results of performance of scientific and technological tasks funded with the state budget; Certificate or certificate of appraisal of results of performing scientific and technological tasks without using the state budget;
- Certificate of registration of technology transfer;
- Other certifications and accreditations have equivalent legal validity.
c) Plan for production and trading of products formed from scientific and technological results according to Form No. 02 in the Appendix to this Decree.
4. Value of Science and Technology Enterprise Certificate
1. The certificate of science and technology enterprise is the basis for the implementation of preferential and supportive policies for science and technology enterprises and takes effect nationwide.
2. The certificate of science and technology enterprise is concurrently a certificate of registration of scientific and technological activities.
3. The certificate of science and technology enterprise is the basis for applying investment incentives to science and technology enterprises.
