Tax Department: 'There is no such thing as collecting lump-sum tax'

After using electronic invoices from cash registers, if the actual revenue of the business household changes by 50% or more compared to the contracted revenue, the contracted tax rate will be adjusted according to the actual revenue.

From June 01, business households and individuals paying lump-sum tax with revenue of 06 billion VND/year or more must use electronic invoices generated from cash registers with data connection to tax authorities.

A business household that has been in business for nearly 30 years shared that they are currently very worried that they will be charged back taxes from previous years based on revenue from invoices calculated from June 01.

In addition, households that do not have invoices for inventory or goods imported before June 01 believe that the policy should allow sellers 06-3 months to process inventory.

A representative of the Tax Department (Ministry of Finance) said that, based on the provisions of Circular 40/2021/TT-BTC, in case a business household pays tax according to the lump-sum method, if there is a change in taxable revenue, it must make an adjustment or supplementary declaration.

Based on the tax declaration records of the contracting households and the tax authority's database, if the actual revenue changes by 50% or more compared to the contracted revenue, the tax authority shall adjust the contracted tax rate according to the actual revenue from the time of change in the tax year.

In case after using electronic invoices from the cash register, the revenue according to the invoice changes compared to the contracted revenue, the above regulations shall also be followed.

Sharing at a press conference on June 16 in Hanoi, Deputy Director of the Tax Department Mai Son stated: "The tax authority calculates the lump-sum tax of business households based on the tax authority's data and the annual declaration of the business household to determine the revenue in the year, and evaluates to determine.

However, during the year, if the business household's revenue increases or decreases, fluctuating by more than 50%, the business household can request the tax authority to adjust the tax rate. The adjustment is only calculated from the time of fluctuation onwards. That is a legal provision, there is no story of additional collection in this policy".

In the process of implementing new regulations and policies of the tax industry, typically the use of electronic invoices generated from cash registers, Mr. Son affirmed that it is inevitable that there will be mistakes and errors.

“Among more than 30,000 tax officials and civil servants, there are individuals who lack patience, courage, and character in the implementation process, causing frustration for the people. We affirm that we will strictly handle those cases,” the Tax Department leader emphasized.

How to invoice inventory?

Regarding the issue of how to issue invoices for inventories, a representative of the Tax Department said that according to the provisions of Decree No. 70 amending and supplementing Decree 123 on invoices and documents, from June 01, business households paying taxes by the lump-sum method with annual revenue of 06 billion VND/year or more; business households paying taxes by the declaration method; business households with cash registers that sell goods and provide services directly to consumers, must use electronic invoices generated from cash registers that transfer data to tax authorities, including transactions of selling inventory of business households.

Tax authorities recommend that business households and individuals ensure the storage of invoices and documents of purchased goods and services according to regulations to provide to other state management agencies when requested, ensuring the origin and quality of goods.

Chairwoman of the Vietnam Tax Consulting Association Nguyen Thi Cuc analyzed that according to current legal documents, purchased goods must have invoices and legal documents to determine their origin.

However, during the transition from lump-sum tax to declaration, there was a situation where the inventory of goods of households did not have full legal invoices.

Ms. Cuc recommends that households must review all inventory, eliminate all goods of illegal origin such as counterfeit goods, smuggled goods, stolen goods (if any) from inventory, process and destroy them, and separate them from goods prepared for sale.

When switching to paying taxes by declaration method, households will pay tax on actual sales revenue. Accordingly, it is recommended that tax authorities not pursue inventory of goods without sufficient invoices and documents, except for the cases of illegal goods excluded above.
