RESOLUTION
ABOUT SOME POLICIES TO SUPPORT EMPLOYEES AND EMPLOYERS MEET DIFFICULT due to the COVID-19 Pandemic
GOVERMENT
Pursuant to the June 19, 6 Law on Government Organization; The Law amending and supplementing a number of articles of the Law on Government Organization and the Law on Organization of Local Government dated November 2015, 22;
Pursuant to the Government's Decree No. 138/2016/ND-CP dated October 01, 10 promulgating the Government's working regulations;
Based on the opinion of the Politburo on a number of policies to support employees and employers facing difficulties due to the COVID-19 pandemic in Document No. 1133-CV/VPTW dated June 25, 6 of the Party Central Committee;
Pursuant to Resolution No. 66-NQ/CP dated July 01, 7 on the June 2021 thematic Government meeting on law-making;
At the proposal of the Minister of Labor, War Invalids and Social Affairs in Report No. 34/TTr-LDTBXH dated June 02, 6 and Report No. 2021/TTr-LDTBXH dated June 45, 28.
DECIDES:
In the face of the complicated situation of the COVID-19 pandemic, which has had a great impact on production, business and people's lives, the Government decided to implement a number of policies to support workers. Employees and employers facing difficulties due to the COVID-19 pandemic are as follows:
I. OBJECTIVES, PRINCIPLES
1. Goals
Support for employees and employers facing difficulties due to the impact of the COVID-19 pandemic, contributing to the recovery of production and business, minimizing the negative impacts of the pandemic, and stabilizing production , business, ensuring life and safety for workers.
2. Principles
a) Ensure timely support, the right audience, publicity, transparency, not to take advantage of, take advantage of policies.
b) Develop criteria and favorable conditions for employees and employers to easily access policies.
c) Ensure feasibility and effectiveness of policies and resources for implementation. Each object is entitled to only once in a support policy. Employees who are entitled to a one-time support in cash (except for those who are entitled to additional policies specified at Points 7, 8, Section II of this Resolution) are entitled to only one support regime; does not support subjects who voluntarily do not participate.
d) Promote the initiative of all levels, branches and localities, based on specific conditions to flexibly deploy, ensure objectives, principles and timely support policies.
dd) State budget support shall be implemented as follows:
Provinces and cities that have a rate of regulation of revenues distributed to the central budget over 60% are self-sufficient in funding for implementation.
The central budget supports the remaining localities on the following principles:
- 80% of the actual expenditure as prescribed in this Resolution for the mountainous provinces, the Central Highlands.
- 60% of the actual expenditure as prescribed in this Resolution for the remaining provinces that have not yet balanced their budgets (besides the mountainous provinces, the Central Highlands).
– 40% of the actual expenditure as prescribed in this Resolution for the provinces and cities that have the proportion of revenue to be distributed to the remaining central budget.
The provinces and centrally-run cities actively use 50% of the local budget reserve (including the 3 levels of province, district and commune) and 70% of the local financial reserve fund, salary reform source. the remaining balance to comply with the principles and support regimes specified in this Resolution.
II. SUPPORTED CONTENT
1. Policy to reduce insurance premiums for occupational accidents and diseases
Employers are entitled to a rate of payment equal to 0% of the salary fund as the basis for paying social insurance premiums to the Insurance Fund for Occupational Accidents and Diseases for 12 months (from July 01, 7 to July 2021, 30). by the end of June 6, 2022) for employees subject to occupational accident and occupational disease insurance (except for cadres, civil servants, public employees, people in the people's armed forces, people laborers in the agencies of the Party, the State, administrative agencies, public non-business units receive salaries from the state budget). The employer will support the entire amount obtained from the reduction of contributions to the Insurance Fund for Occupational Accidents and Diseases for employees in the fight against the COVID-19 pandemic.
2. Policy on temporary suspension of contributions to the retirement and survivorship fund
Employers who have fully paid social insurance premiums or are temporarily suspending contributions to the Pension and Survivorship Fund until the end of April 4 but are affected by the COVID-2021 pandemic, resulting in a reduction from 19% of participating employees. If the employee has received social insurance premium or more compared to April 15 (including the employee who stops working, suspends the performance of the labor contract, and the agreement on unpaid leave), the employee and the employer are entitled to suspend payment to the retirement and survivorship fund for 4 months from the time of application submission. For cases that have been resolved to suspend payment according to Resolution No. 2021/NQ-CP of April 06, 42 and Resolution No. 09/NQ-CP of October 4, 2020 of the Government, if eligible, is still resolved, but the total suspension period does not exceed 154 months.
3. Policies to support training and job maintenance for employees
Employers are entitled to financial support for training, retraining and improvement of vocational skills from the Unemployment Insurance Fund when fully paying unemployment insurance premiums for employees for full 12 months or more by the date of payment of unemployment insurance premiums. ask for support; change the technological structure according to the provisions of Clause 1, Article 42 of the Labor Code; having the revenue of the preceding quarter before the time of requesting for support decrease by 10% or more compared to the same period in 2019 or 2020; have a plan or cooperate with a vocational education institution in developing a plan for training, retraining and improving vocational skills and qualifications in order to maintain jobs for employees as prescribed. The maximum support level is 1.500.000 VND/employee/month and the maximum support period is 06 months. Applications for support are submitted from July 01, 7 to the end of June 2021, 30.
4. Policies to support employees to suspend labor contracts and take unpaid leave
Employees working at enterprises, cooperatives, public non-business units that cover their own recurrent expenditures or investment and recurrent expenditures, people-founded and private educational institutions at the preschool education level, Kindergartens, primary schools, junior high schools, high schools and vocational schools are temporarily suspended at the request of competent state agencies for the prevention and control of the COVID-19 pandemic. current labor contract, take unpaid leave within the term of the labor contract from 15 consecutive days or more, from May 01, 5 to the end of December 2021, 31 and the time the suspension begins perform labor contracts, take unpaid leave from May 12, 2021 to the end of December 01, 5; are participating in compulsory social insurance up to the time immediately before suspending the performance of their labor contracts, taking unpaid leave will be entitled to one-time support as follows: From 2021 consecutive days or more to less than 31 month 12 VND/person; from 2021 month or more, the rate is 15 VND/person.
5. Policies to support employees who stop working
Employees working under the labor contract regime are suspended from work under Clause 3, Article 99 of the Labor Code and are subject to medical isolation or in blocked areas at the request of competent state agencies. authority for 14 days or more during the period from May 01, 5 to the end of December 2021, 31; Those who are participating in compulsory social insurance up to the time right before they stop working are entitled to a one-time support of VND 12/person.
6. Policy to support employees to terminate labor contracts
Employees working at enterprises, cooperatives, public non-business units that cover their own recurrent expenditures or investment and recurrent expenditures, people-founded and private educational institutions at the preschool education level, Kindergarten, primary school, junior high school, high school, and vocational education school terminate their labor contracts due to having to stop operating at the request of competent state agencies to prevent and control the COVID-19 epidemic. during the period from May 01, 5 to the end of December 2021, 31; who are participating in compulsory social insurance but are not eligible for unemployment benefits, receive a one-time support of VND 12/person.
7. Additional support policy and children
a) Pregnant employees at Points 4, 5, 6, Section II will be supported with an additional 1.000.000 VND/person; Those who are raising children or taking care of children under 06 years old are supported an additional 1.000.000 VND/child under 06 years old and only 01 person is the mother or father.
b) Children subject to treatment due to COVID-19 infection or medical isolation under a decision of a competent state agency shall be covered by the state budget for treatment expenses and meals as prescribed at Point 8, Section II This Resolution; receive an additional 1.000.000 VND/child from the state budget during the treatment and isolation period from April 27, 4 to the end of December 2021, 31.
8. Food support at 80.000 VND/person/day for people who have to be treated for COVID-19 (F0) infection, from April 27, 4 to December 2021, 31, the support period depends on the adjustment period. actual value but up to 12 days.
Food allowance of 80.000 VND/person/day for people who have to undergo medical isolation (F1) according to a decision of a competent state agency, from April 27, 4 to December 2021, 31 , maximum support time 12 days.
9. One-time support of 3.710.000 VND/person for art directors, actors, painters holding class IV professional titles in public non-business units performing performing arts (excluding art units of the armed forces) must stop operating for 15 days or more to prevent and control the COVID-19 epidemic from May 01, 5 to the end of December 2021, 31.
One-time support of 3.710.000 VND/person for tour guides issued with tourist guide practice cards affected by the COVID-19 pandemic during the period from May 01, 5 to the end of May 2021 31 year 12.
10. Policies to support business households
Business households with business registration, tax registration and must stop operating for 15 consecutive days or more during the period from May 01, 5 to December 2021, 31 at the request of state agencies competent to prevent and control the COVID-12 epidemic, a one-time support from the state budget of 2021 VND/household.
11. Loan policy to pay wages to stop working, pay wages to restore production
a) Loan to pay salary for job severance: Employers are entitled to a loan from the Bank for Social Policies at 0% interest rate and do not have to take loan security measures to pay the employee's stoppage salary. Those participating in compulsory social insurance must stop working for 15 consecutive days or more as prescribed in Clause 3, Article 99 of the Labor Code, from May 01, 5 to the end of March 2021, 31. The employer has no bad debt at the credit institution and foreign bank branch at the time of applying for a loan. The maximum loan amount is equal to the regional minimum wage for the number of employees according to the actual pay-off period of up to 3 months. The loan term is less than 2022 months.
b) Loans to pay wages for production recovery: Employers must suspend operations at the request of competent state agencies to prevent and control the COVID-19 epidemic from May 01, 5. until the end of March 2021, 31 when returning to production and business and the employer operates in the fields of transportation, aviation, tourism, accommodation services and sending Vietnamese workers to work. overseas under a contract from May 3, 2022 to the end of March 01, 5, can borrow capital at the Bank for Social Policies at 2021% interest rate and do not have to apply loan security measures. to pay wages to employees working under labor contracts and participating in compulsory social insurance. The employer has no bad debt at the credit institution and foreign bank branch at the time of applying for a loan. The maximum loan amount is equal to the regional minimum wage for the number of employees who are working under a labor contract according to the actual salary payment period of up to 31 months. The loan term is less than 3 months.
12. For employees without a labor contract (self-employed) and some other specific subjects:
Based on the specific conditions and budget capacity of the locality, the provinces and cities shall develop criteria, determine the beneficiaries and the support amount, but the support level is not lower than 1.500.000 VND/person/time or 50.000 VND/person/day based on the actual number of days of suspension at the request of the locality.
III. ORGANIZATION OF IMPLEMENTATION
1. Ministry of Labor, War Invalids and Social Affairs:
a) Assume the prime responsibility for, and coordinate with concerned agencies in, submitting to the Prime Minister for promulgation a Decision to implement the contents specified in Section II of this Resolution according to the simplified order and procedures.
b) Assume the prime responsibility for, and coordinate with relevant agencies in, inspecting and urging the implementation of the Resolution, promptly proposing the Government and the Prime Minister solutions to remove arising difficulties and problems.
c) Adjust the funding to support meals for children undergoing treatment due to COVID-19 infection or medical isolation at the request of competent authorities from the Child Protection Fund to supporting children with disabilities. other special scenes according to the content agreed with the sponsor.
2. Ministry of Finance:
a) Secure the state budget to implement the policies specified in this Resolution.
b) Pursuant to the provisions of the Resolution, relevant laws and regulations and the actual expenditures of localities (certified by the State Treasury) for timely consideration and support from the central budget for each individual. localities, periodically summarize and report to the Prime Minister on implementation results.
3. Ministry of Culture, Sports and Tourism:
To guide the implementation of support policies according to the provisions of Point 9, Section II of this Resolution.
4. Ministry of Planning and Investment:
Assume the prime responsibility for reporting to the competent authorities to fully allocate capital from the public investment plan to provide management fees for the Bank for Social Policies to implement the task of lending loans to the employer to pay salaries to employees. according to actual disbursement.
5. State Bank of Vietnam:
a) Assume the prime responsibility for, and coordinate with the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Finance, the Ministry of Planning and Investment, Vietnam Social Insurance and relevant agencies in, promulgating the Circular guiding the order, simplified procedures and refinanced loan to the Bank for Social Policies up to VND 7.500 billion with interest rate of 0%/year, refinancing term under 12 months and no collateral for employers activities specified at Point 11, Section II of this Resolution to pay salaries to employees. The time limit for disbursement of refinancing is until the end of March 31, 3 or when the refinancing amount is fully disbursed, whichever comes first.
b) It is allowed to use the risk provision set up from the difference between revenue and expenditure of the State Bank of Vietnam to deal with the refinancing debt specified in this Resolution which is overdue for 03 years or more.
6. The Bank for Social Policies shall guide and implement the lending policy in accordance with the provisions of Point 11, Section II of this Resolution.
7. Vietnam Social Insurance shall implement policies within the scope of responsibilities specified in this Resolution.
8. People's Committees of provinces and centrally run cities:
a) Actively use local resources and direct the implementation of policies specified in Section II of the Resolution; report on the results of implementation according to the support schedule and send it to the Ministry of Finance for summarization and submission to competent authorities for support.
b) To assume the prime responsibility for determining and approving the list of beneficiaries of the regime specified at Points 4, 5, 6, 7, 8, 9, 10, Section II of this Resolution; organize the implementation to ensure timely, effective, publicity, right audience, not to take advantage of and take advantage of policies.
c) Based on the actual situation of the locality, to issue support policies as prescribed at Point 12, Section II of this Resolution from the local budget and other lawful mobilized sources.
9. The Ministry of Information and Communications shall assume the prime responsibility for, and coordinate with the Central Committee for Propaganda and Training, ministries, central and local agencies, and news agencies and newspapers in organizing the dissemination and dissemination of the Resolution. this.
10. Requesting the Central Committee of the Vietnam Fatherland Front, the Vietnam General Confederation of Labor and socio-political mass organizations to participate in the dissemination, coordination, implementation and supervision of the implementation of the Resolution .
11. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, presidents of People's Committees of provinces and centrally run cities are directly responsible to the Government and Prime Minister for the implementation and results of this Resolution.
