Accelerating tax collection from e-commerce platforms (Google, Facebook, YouTube, Netflix, Apple, e-commerce platforms)

This is one of the key projects to be implemented in the near future, the Director of the Tax Department of Ho Chi Minh City said.

Tax collection base for businesses

Currently, there are about 14 large corporations and technology companies in the world and 8 websites operating cross-border e-commerce (e-commerce) with income in Vietnam that have fulfilled tax obligations.

The tax revenue is from Vietnamese organizations that have signed online advertising contracts with foreign organizations that do not establish legal entities in Vietnam such as Google, YouTube, Facebook... This individual is obliged to declare and pay tax on his behalf.

The amount of tax arising from 2018 to the end of September 9.2021 is about VND 4.099,68 billion. In which, some large corporations such as Facebook are 1.576,72 billion VND; Google is 1.529,25 billion VND; Microsoft is 533,01 billion dong. 

Tax collection base for income-earning individuals

Individuals earning income from platforms such as Google, Facebook, YouTube, Netflix, Apple ... must pay personal income tax.

According to the data provided by 4 commercial banks, in 2020 and the first three months of 2021, there were 4.784 organizations and individuals with income arising from Google, Facebook, YouTube, Netflix, Apple, with a total money received from abroad is 48 million USD and 20 billion VND. In recent years, the Tax Department of Ho Chi Minh City has also coordinated with the Department of Radio, Television and Electronic Information (Ministry of Information and Communications) to work with Google's partner companies in Vietnam (commonly known as Google). MCN - Multi Channel Network, multi-channel network system) is in charge of managing YouTube channels that produce digital content themselves and pay Google's money for individuals who are YouTubers in Vietnam; then there is a written request for MCNs to deduct tax and remit into the state budget in accordance with regulations. The tax authority also provides the names of organizations and individuals providing digital content services that receive income from Google but do not agree to withhold and pay tax instead. The results recorded were 3.101 individuals with a revenue of 379 billion VND, collected and remitted to the state budget 20 billion VND.

Provide data to tax authorities according to electronic standards

From January 1.1.2022, 8, e-commerce platforms provide information to tax authorities according to data standards by electronic means. Previously, the General Department of Taxation coordinated with the Ministry of Industry and Trade to survey a number of e-commerce platforms in August to develop data standards and draft data standards to collect opinions from exchanges. From October 1.10.2021, 1.1.2022 to January XNUMX, XNUMX, the General Department of Taxation and e-commerce platforms will upgrade the application to ensure the provision of information according to the standard format by electronic means.

In order to manage buying and selling activities through e-commerce trading floors, social networking sites (Facebook, YouTube, Zalo, etc.) there are businesses (DN) to deliver and deliver goods to and from customers. In the hands of buyers and authorizing these businesses to collect sales money, the tax authority has built a mechanism to provide information of businesses providing logistics services, delivery services, especially businesses that collect money from sales. (COD) of organizations and individuals doing business in e-commerce to tax authorities, with the content provided including the quantity of goods transported and the amount collected. By the end of June 6.2021, only the data collected in 2017 and 2018 in the city were 14.686 organizations and individuals, with a total collected amount of nearly 15.100 billion VND. Currently, the tax authority is implementing the determination of the implementation of tax obligations for the organizations and individuals on the list, requesting explanations and handling according to regulations for violations.

Law on Tax Administration No. 38, effective from July 1.7.2021, XNUMX, refers to the coordination mechanism between tax authorities and agencies, including banks, so the ability to collect data is more than enough, contributing to the fight against loss of budget revenue in the field of e-commerce.
